Medical Operational HearingsMedical operational hearings involve drivers that have suffered a loss of consciousness or a seizure, or suffer from some other medical condition that may affect his or her ability to safely operate a motor vehicle. The experienced attorneys at McGregor & Ernenwein have successfully represented clients in dozens of these hearings before the DMV. Medical personnel, including physicians and nurses, will sometimes notify the DMV if they believe a patient has a medical condition that would prevent them from safely operating a motor vehicle. In such matters, a driver would receive a notice requiring a hearing before the DMV. The driver is allowed to have an attorney present at the hearing. Having an attorney familiar with the DMV and their administrative laws can be an immense advantage at these hearings. The experienced attorneys at McGregor & Ernenwein regularly represent clients in medical operational DMV hearings. Generally, our approach is to attempt to convince the DMV hearing officer that the alleged medical condition does not cause the driver to be a danger on the roadway. We will support our arguments with an independent medical evaluation or with a supplemental report from the medical provider. Appropriate medications, if properly documented, can often convince the hearing officer not to suspend the driving privilege. Attorneys at McGregor & Ernenwein have been representing clients before the DMV in these medical operational hearings for over eighteen years.
