Are You Eligible for a California Dismissal? Torrance Criminal Defense Lawyers Explain

A California conviction dismissal refers to a court's ruling that a prior criminal charge be terminated from your record. However, in order to be considered for a dismissal, you must have been convicted of either a misdemeanor or a felony crime that did not result in you doing time in a state prison. Thus, as a punishment, you were given a fine, probation, county jail time, or any combination of these three penalties.

More specifically, you may be eligible for a conviction dismissal if you meet the following criteria:

  • You are not on probation for another conviction and you are not currently imprisoned for another crime.

  • You were released early or successfully completed the terms of your probation.

  • You paid all of the required reimbursements, fines, restitutions, etc.

  • You have not been recently charged with another offense.

In the case that you did not receive probation, you may be eligible for a dismissal provided that:

  • Your conviction was not a felony, but instead was a misdemeanor.

  • At least one year has passed since you were originally convicted.

  • At present, you are not serving a sentence for another crime - and you have not been charged with another crime.

  • You have fully complied with the terms of your particular sentence.

  • Since your conviction, you lived an honest lifestyle and obeyed the law.

In the case that you were not granted an early release, but you did successfully complete the terms of your probation or some of the probation terms, you may be eligible for a dismissal provided that:

  • You are not serving a sentence for another crime, you are not on probation for another crime, and you currently not charged with another crime.

  • You repaid all reimbursements, fines, restitution, etc. required of you.

All that said, it is up to the discretion of the court to alternately determine whether or not your particular criminal offense should be dismissed.
