Dismissal of Underage DUI Charge out of Torrance Courthouse

Our client, a minor, charged with under 21 (.01% or greater BAC), was facing a one (1) year suspension of his driving privilege, a significant insurance premium increase, court fines and a lengthy alcohol program. Robert Ernenwein argued a pretrial motion to suppress the result of the preliminary alcohol screening device based on the prosecutor failing to subpoena the appropriate officer (i.e., the one who conducted the PAS test).  Mr. Ernenwein argued that without the officer testifying about calibration of the device, the prosecutor could not introduce his blood alcohol content into evidence. The judge granted the Motion to Suppress and the case was dismissed.
