Dismissal of Criminal Threats Charge, Cal. Pen. Code Section 422, a Strike

Client, young man in his 20's attending college, was charged with making "Criminal Threats" (a violation of California Penal Code 422 PC) and "Stalking" (a violation of California Penal Code 646.9 pc). Because the criminal threats charge was a strike offense under the Three Strikes Law, and the young man faced potentially years in the California State Prison, our South Bay criminal defense lawyer, Lorgio Coimbra, diligently and assiduously sought to avoid a conviction the Cal. Pen. Code 422 charge for his client.

The charges emanated from a lengthy series of text messages aimed at the client's ex-girlfriend containing menacing threats after a relationship fall-out.

Mr. Coimbra negotiated extensively with the prosecutor to seek a reduction of the charges. After presenting elaborate documentation regarding the client's promise and potential, and arguing for a dismissal of the criminal threats charge, Mr. Coimbra was able to obtain for his client a dismissal this strike offense, sparing him from a crippling criminal record that would have included a Strike on his record under the Third Strikes Law.  

Further, by pursuing alternative sentencing on the second offense that included counseling, Mr. Coimbra was able to prevent his client from having to serve any state prison or county jail time on the remaining charge.
