DISMISSAL OF BATTERY CHARGES

Client was involved in an alleged battery at a rock concert.  He allegedly attacked some security guards.  The first offer by the prosecutor was to have the client placed on probation with a criminal conviction.  The next offer.  After negotiations occurred, the prosecutor then offered "deferred entry of judgment" where the client would plead guilty but have his sentencing continued and have the case ultimately dismissed.  Unsatisfied, we continued negotiating.

We ultimately reached an agreement with the prosecutor that the client would submit a DNA sample and have his case dismissed.  This was done under the so-called "Spit and Acquit" program in Orange County.  Our client lived outside of Orange County and it was extremely inconvenient for him to travel to Orange County for his court appearances. Therefore, we made all the court appearances for him.

willing to go to court as many times as necessary to obtain the best possible settlement.  This case is an example of
a strategy whereby we return to court time after time and continue to negotiate until the prosecutor makes the best

possible offer.  In this case, that strategy resulted in the dismissal of the charges.
