DISMISSAL OF ASSAULT CHARGE & NO JAIL TIME ON VANDALISM CHARGE

In an alleged road rage incident, our client purportedly attacked another driver with a crowbar.  The client was charged with Felony Assault with a Deadly Weapon (in violation of California Penal Code Section 245(a)(1)), a Strike.

The use of a weapon (in violation of California Vehicle Code Section 12022(b)(1)) The client was also charged with Felony Vandalism (under California Penal Code Section 594(a)).  The client was facing six (6) years in the California State Prison.  The original offer was for 2 years in the California State Prison and required the Defendant to admit to a Strike.  Our Torrance criminal defense law office made six (6) court appearances, including conducting a Preliminary Hearing for the Client. The final result? The assault (strike) charge was dismissed. The client pled to vandalism for Probation and No Jail Time.

How was this result obtained?

Through a cross-examination of the alleged victim at the Preliminary Hearing and through negotiations with the District Attorney, we were able to convince the District Attorney to drop the most serious charge and to allow our client to remain with his family and to keep his job.  It is through hard work and negotiation that our Torrance road rage defense lawyers are able to obtain favorable plea bargains for our clients.
